Reporting Requirements for FAA Form 7460-1

Notice to the Federal Aviation Administration (FAA) may be required for a new structure or altered structure based in part on the following requirements and shall be reported on FAA Form 7460-1 (Notice of Proposed Construction or Alteration).

 

What are the reporting requirements for constructing a new structure or for an alteration to an existing structure?

 

First, if a new or altered existing structure will be more than 200 feet above the ground at its site, it meets reporting requirements.

 

Second, any new or altered existing structure that penetrates an airport’s imaginary Notice Surfaces meets reporting requirements.  Federal Air Regulation (FAR) Part 77.13 defines the various runway lengths and associated slopes and distances from the airport for these imaginary surfaces.

 

Third, any construction or alteration on a public or military airport most likely will meet reporting requirements.  There are certain other unnamed requirements not listed for brevity sake.

 

Finally, there are reporting requirements for the construction or alteration of highways, railroads or other traverse ways for mobile objects (trains or ships) that if of sufficient adjusted height would exceed FAR Part 77 standards.

 

The FAA will assign an Aeronautical Study Number to a sponsor’s submission, perform an Aeronautical Study to determine if the structure is an Obstruction to Air Navigation and issue one of the following determinations to the sponsor: Determination of Hazard; Determination of No Hazard; Notice of Presumed Hazard; Does Not Exceed; Exceeds But Okay.

 

To ensure that sponsors avoid potential unfavorable FAA determinations, it would be practical to engage an aviation consultant who has extensive expertise in developing innovative and workable solutions that will allow them to develop their structure as planned.
